(4) The High Court shall not order compensation to be paid
under subsection (3) unless it is satisfied
(a)
that there has been some serious default on the part of any
person concerned in the investigation or prosecution of the
offence or offences concerned and that, but for that
default, the act or omission referred to in subsection
(3)(b) would not have occurred; and
(b)
the applicant has, in consequence of the act or omission
referred to in subsection (3)(b), suffered substantial loss
in relation to the property.
(5)
The amount of compensation to be paid under this section
shall be such as the High Court thinks just in all the circumstances
of the case.
Enforcement of external orders
29. (1) The Governor in Council may, with the approval of the
Legislative Council, by order
(a) direct in relation to a country or territory outside Hong
Kong designated by the order ("a designated country") that,
subject to such modifications as may be specified, section
2(11) and (12) and sections 9 to 19 shall apply
(i) to orders ("external confiscation orders") which
are made by courts in the designated country for purposes
