Definition of "Qualified/Unqualified Persons" under the Television Ordinance (Chapter 52)

In order to be "qualified" for the purposes of the Ordinance an individual must be -

(i)

ordinarily resident in Hong Kong;

and

(ii) have at some time been so resident for a continuous period of at least 7 years.

and a company must be ordinarily resident in Hong Kong.

2.

"Ordinarily resident in Hong Kong" is itself defined in section 2 of the Ordinance as including

(a)

(b)

in the case of a person

(i)

(ii)

residence in Hong Kong for not less than 180 days in any calendar year;

or

residence in Hong Kong for not less than 300 days in any 2 consecutive calendar years; and

in the case of a company, a company

(i)

which is formed and registered in Hong Kong under the Companies

Ordinance;

(ii) of

which

the

participating actively direction of the company

(B)

directors

in

the

2 such

(A) in case there are

directors, each shall be; or in case there are more than 2 such directors, the majority thereof shall be,

for the time being ordinarily resident in Hong Kong and also have been so resident for at least one continuous period of not less than 7 years; and

(iii) the control and management of which

is bona fide exercised in Hong Kong.
