The proposals of Supertech and WTS as received on 28 February 1989 did not meet the requirements of the Government's Guidance Note, and contained insufficient information for the Government effectively to assess the proposals vis-à-vis the substantial proposals submitted by HKCC and HCV. We consider that the proposals submitted by Supertech and WTS on 28 February 1989 are inadequate and recommend that
that they should be rejected: this
be rejected: this recommendation accords with the views of the BA, detailed in paragraph 12.
The Assessment by the BA

At the request of the Council
of the Council, the BA has conducted an enquiry into a suitable system of CTV for Hong Kong, and has examined all four proposals submitted on 28 February 1989. The Council's request that the BA conduct an
examination of the legislative, technical and regulatory
framework for the implementation of the CTV system will be carried out at a later phase, after the successful bidder has been chosen.

The BA's Report is at Annex D. In its enquiry the BA concentrated on CTV programming, advertising, marketing, market assessment, customer servicing and regulatory matters. The BA also had regard to the proposals concerning telecommunications technology, construction techniques, financial planning and Government revenue, but did not attempt a detailed assessment of such aspects
instead, it noted the views of the Administration and the consultants in these areas.
In its evaluation of the bids, the BA considered not only what was offered in the bids but also whether the bidder was likely, or able, to keep to what he had offered; in this regard the general reputation and track record of the companies concerned, the robustness of their financials, their personnel and their ability to obtain the relevant technical facilities were all examined. formulating its Report, the BA had access to the original proposals and the full report of the consultants, as
as well as analyses of the submissions prepared by its secretariat. addition, the Authority was briefed by each bidder at presentations conducted on 13 April 1989, and received а briefing from the consultant s on 9 May. Detailed clarification requested by the BA was provided by the bidders.
