I have the following comments of detail on the British Council's letter of 9 May 1988: first, it is not clear whether the British Council has a discretion to use the capital as well as the income. That needs to be made clear. Secondly, consideration needs to be given to whether HMG should retain a residual power to authorise the use of the capital for the purposes envisaged in the letter; also a power to authorise the application of the capital/income for other purposes. Thirdly I do not understand the word "possible" in sub-paragraph 4.

2. A more general point is that before we go firm on these arrangements we should consult the Charity Commissioners, tell them what is proposed, and ask them if they have any comments.
