capacity as CWGC agent in Hong Kong, protects the CWGC interests in the cemetaries and takes care of their day-to-day running. Evidently, as you note, there is potential for conflict between these two roles, and the CWGC may wish to appoint an alternative agent. Again we should tell the Chinese if the SAR Government is to continue to have these responsibilities, whether for the CWGC cemetaries and/or for other public cemetaries.
(c) We need to establish whether the vesting of the land in the Crown under the Deeds of Appropriation is in "the Crown in right of UK" or "in right of Hong Kong". If the former, the potential for difficulties is greater. We should clarify to the Chinese exactly how this land is held.
(a) It might be appropriate in the Land Commission paper to go into a little more detail about the nature of the use to which these various plots of
are being put and the organisations using them.
We may need to explain to the Chinese, if only on a defensive basis, exactly what the CWGC is.

Para 6 of the draft ExCo paper refers to Commonwealth war graves and memorials other than the two cemetaries. It would be helpful if you could give us details of these.
