LEGAL REPORT

Enclosure No. 2.

BOILERS AND PRESSURE RECEIVERS (AMENDMENT) ORDINANCE 1988

(No. 87 of 1988)

The main purpose of this Ordinance is to amend the Boilers and Pressure Receivers Ordinance to provide for the appointment of a Boilers and Pressure Vessels Authority who is to be solely responsible for performing the functions previously performed by the Registrar of Boilers and Pressure Receivers and the Principal Surveyor, and to give additional powers to the Authority

(a) to issue codes of practice;

(b)

(c)

to extend or reduce the period of validity of certificates of fitness for boilers and pressure vessels; and

to reduce the maximum permissible working pressure of boilers and pressure vessels for which the required documentation has not been produced.

2. The provisions of the principal Ordinance relating to boilers generating steam are extended so as to apply to vessels in which oil is heated at a pressure greater than atmospheric pressure. Certain types of such vessels are, however, exempted by virtue of section 3 of the principal Ordinance.

3.

The changes in terminology are made to bring the terminology into line with international usage. Equipment previously included within the definition of a "pressure receiver" now falls within the definition of a "pressure vessel"; and equipment previously referred to as a "pressure vessel" is now referred to as a "pressurized fuel container".
