ANIMALS AND PLANTS (PROTECTION OF ENDANGERED SPECIES) (AMENDMENT) ORDINANCE 1989
(No. 25 of 1989)
The
object of this Ordinance is to amend the Animals and Plants (Protection of Endangered Species) Ordinance which implements the 1973 Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) which has been ratified by the United Kingdom and extended to Hong Kong.

(a)
The amendments seek to
-
restrict the possession of controlled medicines generally Chinese herbal medicines - which contain rhinoceros ingredients: this accords with a CITES resolution to prohibit any trade in rhinoceros including its
parts
derivatives;
(b) increase the level of fines;
and
(c)
extend controls on the transhipment of endangered species in accordance with CITES recommendations;
(d)
(e)

penalize the giving of false information in respect of endangered species; and
extend the powers of search and forfeiture.
Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
