ANIMALS AND PLANTS (PROTECTION OF ENDANGERED SPECIES) ORDINANCE (REPLACEMENT OF SCHEDULES) ORDER 1988

THE PROBLEM

under

The First, Second and Third Schedules made Animals and Plants (Protection of Endangered Species) Ordinance list respectively all animals, animal parts and derivatives, and plants which require to be protected or controlled in trade to prevent extinction. Entries in the Schedules are based on the recommendations of the biennial Conferences of Parties to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). The Schedules need to be updated to take account of

account of the recommendations of the 1985 and 1987 CITES Conferences.

The Fourth Schedule made under the Ordinance sets out licence fees for the import, export and possession of scheduled species. These fees were set in 1976 and it is necessary for them to be increased so as to restore their real values.

RECOMMENDATION AND ADVICE SOUGHT

It is recommended that under Section 19(1) of the Animals and Plants (Protection of Endangered Species) Ordinance (Chapter 187), the Animals and Plants (Protection of Endangered Species) Ordinance (Replacement of Schedules) Order 1988 as out, in Annex A should be made.
