Dear Mr. Edwards

First Pacific Bank Limited Bill

I enclose a first draft of the above Bill, which

is being promoted as a private Bill. Since the Bill affects two banks, I am referring it to you under clause XXVI of

the Royal Instructions. The background to the Bill is explained in two letters from Messrs. Richards Butler (solicitors for the promoters) to the Commissioner of Banking dated 17 & 23 August (copies enclosed).

The Bill is not yet in a form that complies with the Standing Orders of the Legislative Council, as minor stylistic changes are needed. I would, however, be grateful if you would consider the Bill from a substantive point of view and confirm whether it may be proceeded with without further reference to the Secretary of State.

You will no doubt wish to be satisfied that the Bill has no extra-territorial application. In this regard, the solicitors for the promoters of the Bill have informed the Commissioner of Banking that Far East Bank does not have any assets or business outside Hong Kong.
