A 1. A letter from Charles Kennedy MP, enclosing one from his

constituent, Mr T S H Burns, a Solicitor of Park Street, Dingwall,

Ross-shire.

Recommendation

I recommend that Lord Glenarthur replies on the lines of the

attached draft. The Legal Advisers and the Hong Kong Government

have been consulted.

Background

3. The draft reply is self-explanatory. We cannot help much since this problem is not the responsibility of HMG or the Hong Kong Government. Probate and grants of confirmations are a matter for

the Registrar of the Supreme Court in Hong Kong. But as Mr Kennedy has taken this up with Lord Glenarthur on Mr Burns' behalf, the

Hong Kong Government has asked the Registrar of the Supreme Court to investigate this particular case. The draft reply incorporates the Registrar's reply without comment.
