(b) knowingly furnishes to the Commission in purported
compliance with the requirement information which is false
or misleading in a material particular,
commits an offence.
Certification to High Court relating to non-compliance under section 28 or 29
30. (1) If a person mentioned in section 28 or 29, without
lawful excuse, fails to produce any record or other document or
disclose information upon being required to do so under that section,
the Commission may certify the failure to the High Court and the High
Court may thereupon inquire into the case and
-
(a) order such person to comply with the requirement within
such period as may be fixed by the High Court; or
(b)
if the High Court is satisfied that such person has failed
without lawful excuse to comply with such requirement,
punish him in the same manner as if he had been guilty of
contempt of court.
(2) A person punished under subsection (1) may nonetheless be
prosecuted for an offence under section 28 or 29 in respect of the
failure for which he has been so punished.
