The reasons and aims of the draft Treaty are acceptable.
In the third paragraph, the point should be made more explicitly that the encouragement of technology transfer is a result of adequate protection. The following wording for this paragraph should therefore be proposed : "With a view to laying the groundwork for the promotion of broader
dissemination of microchip products and the transfer of technology
towards developing countries, in particular by encouragement of voluntary
licensing."
Title of the draft Treaty
Community Position
The change of title is partly the result of the new definitions, but it is to be regretted that there is no longer a reference to "intellectual property". To rectify this, the following title should therefore be
proposed : "Draft Treaty on the Protection of Intellectual Property in
respect of Layout-Designs (Topographies) of Microchips"
Article 1 (Establishment of a Union)
Community position.
Whether or not the proposed constitutional structure of a Union is
necessary will depend on the tasks of the Assembly. The proposal to
create a Union is the result mainly of the Increased tasks which will
arise from the dispute settlement mechanism and the possibility of
amending the Treaty. A particular factor in this relates to the financial implications, which might not be covered by the general costs
