(a)
(2) [Minimum Duration Where Exploitation or Registration Required]
Where the faculty provided for in Article 7 has been made use of,
protection shall last at least five years
(i) from the date of the starting of the commercial exploitation,
where Article 7(1)(i) applies,
(ii) from the date of the filing of the application for registration,
where Article 7(ii) applies, or
(iii)
from the earlier of the two dates specified in (i) and (ii),
above, where both Article 7(i) and Article 7(ii) apply.
(b) Where, at the expiration of the five-year period referred to in
subparagraph (a), the layout-design (topography) has a commercial value, the
competent authority of the Contracting Party shall, on the request of the
holder of the right, grant an extension of the duration of the protection;
such extension shall not be less than [Alternative N1: 30 months]
