CHAPTER 1

INTRODUCTION

1.1

In August 1988, the Government announced the

following policy proposal

(a)

(b)

(c)

in consultation with the Law Society, to devise a statutory scheme laying down formal criteria for the admission, through the Chief Justice, of

foreign law firms;

in consultation with the Law Society, to devise

a scheme, with clearly laid down powers, to

enable the Law Society to exercise powers of

discipline over foreign law firms similar to the

powers it presently exercises over Hong Kong

solicitors; and

to enable foreign law firms to take in, as partners or employees, Hong Kong solicitors who may practise Hong Kong law.

Purpose of Consultative Document

1.2

When the proposal was announced the Government indicated that details of the schemes would be formulated

after due consultation with all interested parties. This paper seeks to consult the public on the details of the schemes. The purpose of this document is not to rehearse the reasons behind this proposal; these are set out in the

Fact Sheet released separately.
