BASIC LAW

COVERING RESTRICTED

Drafting of Basic Law is progressing well. Have had fruitful

behind-the-scenes dialogue with Chinese.

Some problems remain. But Chinese officials have repeatedly

stated that draft is open to further amendment. Welcome this

reassurance.

Will study second draft very carefully when it is published. Will ensure that concerns of Hong Kong people are conveyed to

Chinese authorities.

Know that provisions on political structure are subject of intense debate in Hong Kong. Clear that there are still differences

of view. Hope Hong Kong people will be able to agree on consenus formula which commands widest support and confidence.

NATIONALITY AND IMMIGRATION MATTERS

Aware of sensitivities in Hong Kong. There is a very long history to this.

Key point is that we are working to create conditions in which

people want to stay in Hong Kong. Therefore committed to Joint Declaration and to work for continued stability and prosperity of

Hong Kong.

(Comparisons with Macao?)

No direct comparisons can be made.

Present position reflects different historical and constitutional factors which apply in each

case.

(Worse treatment for Hong Kong than other dependent territories?)

Not so. British nationals in Hong Kong treated in same way as those in most other Dependent Territories. But special considerations apply to Gibraltar (member of EC) and Falkland
