section 3(5) and section 3(5A) establish a new voting

procedure, quorum and majority for resolutions without a

meeting of the Commission.

3. Clause 3 makes a consequential amendment to section 4, as

the appointed judges may be from the Court of Appeal.

Clause 4 amends section 12 so that the Governor in Council

rather than the Governor alone shall prescribe the extent to which

representations by a judicial officer can be made to the Commission.

Clause 5 repeals section 13(2) which is no longer relevant

due to the removal of the requirement for unanimous voting from
