Explanatory Memorandum
The main object of this Bill is to amend the Judicial
Service Commission Ordinance to revise the membership of the
Commission and alter its quorum and majority provisions.

(a)
In clause 2
section 3(1)(c) is repealed to remove the Chairman of the
Public Service Commission from membership on the Judicial
Service Commission;
(b) section 3(1)(d) is amended to increase the number of
appointed members from 3 to 7, making a total membership of
9 including the ex officio members. The 7 appointed
members must be as set out in the section. Under the new
section 3(1A) the Governor must consult with the Bar
Association and the Law Society before making appointments
under section 3(1)(c)(ii). Under section 3(1B) the Bar

Association and the Law Society may recommend persons to be
appointed but the Governor is not limited to making an
appointment from among those recommended;
section 3(3) and the new section 3(3A) increase the quorum
to 6 members and remove the requirement for unanimous votes;
