The Chinese legal term "daibu" (
) is commonly translated into English as meaning "arrest". However it is clear that the Chinese concept of arrest is something completely different from the common law concept. There are many forms of detention in China which need not be preceeded by the formalities of arrest in order to be lawful. Under the Criminal Procedure Law arrest is a procedural device which is used to approve lengthy periods detention for criminal suspects pending the outcome of investigation and trial.
