Members

of the

Legislative Council of the Hong

Kong SAR shall

shall not be subject to arrest when attending or on their way to a meeting of the Legislative Council.

Article 78

The President of the Legislative Council declare that a member of the Council is no longer qualified

to serve under any of the following circumstances:

(1) When he/she los es the ability to discharge

functions of his/her office due to

serious illness or other reasons;

When he/she is absent from meeting for three

consecutive months without the consent of the

President of the Legislative Council and with

no reasonable explanation;

When he/she loses or renounces his/her status

as a permanent resident of the Hong Kong SAR;

When he/she accepts appointment by the

government as public servant;

When he/she is bankrupt or fails to pay debts

in defiance of a court ruling;

convicted and

sentenced to

imprisonment for

criminal offence comitted within or out side

the Hong Kong SAR and is relieved of his/her

duties by a motion passed by two-thirds of

members of the Legislative Council

When he/she is censured for misbehavior or

breach of oath by a vote of two-thirds of the members of the Legislative Council present.
