The laws of the Hong Kong SAR shall be this Law,
the laws previously in force in Hong Kong as stipulated in
Article 8 of this Law,
and the laws enacted by the
legislature of the Hong Kong SAR.
Laws enacted or confirmed by the NP C or its
Standing Committee shall not be applied in the Hong Kong SAR except for those listed in Annex III to this Law. Laws listed in Annex III to this Law shall be applied locally by
the Hong Kong SAR by way of promulgation or legislation.
The Standing Committee of the NPC, after
consulting its Committee for the Basic Law of the Hong Kong
SAR and the Government of the Hong Kong SAR, may make
additions to or deletions from the list of laws set out in
Annex III to this Law. Laws to be listed in Annex III
shall be confined to those relating to defence and foreign
affairs as well as other laws which, in accordance with the
provisions of this Law, are outside the limits of the Hong
Kong SAR's autonomy.
When the Standing Committee of the NPC decides
that the Hong Kong SAR is in a state of emergency because
of war or unrest, the State Council may decree the
application of the relevant laws in the Hong Kong SAR.
Article 19
The Hong Kong SAR is vested with independent
judicial power, including that of final adjudication.
Courts of the Hong Kong SAR shall have
jurisdiction over all cases in the Hong Kong SAR, except that the restrictions of their jurisdiction imposed by Hong Kong's previous leg al sy stem and principles shall be
maintained.
