Does Lord Glenarthur wish to
attend the informal briefing
meeting on 8 March? We
should in any case explore
what other opportunities
there will be for the
Minister's involvement.
4.
Involvement of Officials
(a) FCO
Lord Glenarthur has agreed that
Mr McLaren should take the lead
in giving oral evidence.
(b) Hong Kong
Legal position.
1
How to deal with the
Governor's query (Hong Kong telno 392) as to whether Hong
Kong Government officials are
formally obliged to give
evidence?
If the Governor is asked
to give evidence, should
he agree to give evidence
in closed session in
Hong Kong or public
evidence in London?
Legal Advisers have confirmed
that the position as outlined
in FCO telno 325 is correct.
(The Secretary of State is
ultimately responsible to
Parliament for the actions of
officials in dependent territories regardless of their nationality, even in
matters which have been
devolved to the HKG).
