Mr Gillmore recorded that the Foreign Affairs Committee have
asked for a very short factual paper setting out the "division of
responsibilities" between HMG and the Chinese Government in
connection with the future of Hong Kong. I submit a draft, which
has been cleared with the Legal Advisers.

The note is entirely factual and keeps very closely to the
text of the relevant instruments.

Only paragraph 8 needs comment. This tends to cut across a
neat "division of responsibilities" by indicating that the British
Government does have a certain indirect standing in relation to the
drafting of the Basic Law. It is possible that the Committee could
use it as a pretext for extending their enquiries to include the
substance of the Basic Law and details of the drafting process.
