(2) An order under subsection (1) may—

(a) be made at any time during the proceedings;

(b) be made subject to conditions as to the time for payment of costs

referred to in subsection (1); and

(c) award costs on an indemnity basis.

26. (1) Subject to this Ordinance, the Criminal Procedure Ordinance Application of shall apply to proceedings transferred to the court under section 4 with such Criminal modifications as may be necessary for that purpose.

Procedure Ordinance

(2) Nothing in this Ordinance shall be construed as limiting the (Cap. 221) powers of the court under the Criminal Procedure Ordinance.

27. The Chief Justice may, with the approval of the Legislative Council, make rules and orders regulating the practice and procedure under this Ordinance.

Consequential Amendments

Crimes Ordinance

28. Section 33 of the Crimes Ordinance is amended-

(a) by repealing "or" at the end of paragraph (a);

(b) by adding "or" at the end of paragraph (b); and (c) by adding after paragraph (b)—

(57 of 1988)

"(c) served and delivered under sections 6, 13 or 21 of the

Complex Commercial Crimes Ordinance 1988,”.

29. Section 24A(1) of the Criminal Procedure Ordinance is amended When by adding after paragraph (a)—

suant to an order made under section 4 of the Complex Commercial Crimes Ordinance 1988; or”.

Section 65D of Cap. 221 is amended-

(a) in subsection (3) by repealing "section 82 of the Magistrates

Ordinance" and substituting----

(57 of 1988)

"section 85A of the Magistrates Ordinance or section 4 of the Complex Commercial Crimes Ordinance 1988, as the case may be,";

(b) in subsection (6) by adding after "committal proceedings"-

(57 of 1988)

"or upon the making of an order of transfer under section 4 of the Complex Commercial Crimes Ordinance 1988, as the case may be,"; and
