Mr Justice Barker
At our meeting on 4 March, at which Sir T L Yang was also present, we discussed at length the allegations made about Mr Justice Barker's conduct of, and behaviour during, the Carrian case. A full record will be sent to you separately.
We agreed that you would see Mr Justice Barker again as soon as possible and make the following points:
(a) inform him that, in your opinion, he had, as he
himself has admitted, behaved irresponsibly during the Carrian trial in attending a cocktail party given by the defendant's solicitors and in speaking on a number of occasions about his view of the trial;
(b)

that in the light of this and because of what his fellow judges on the Court of Appeal have said about their lack of confidence in him, you think it is right to remove him from the Court of Appeal and put him into a non-judicial post;
that you believe that it would be best for all concerned if he were to agree that he would leave the Judiciary when his present contract expires on 29 December and should in due course inform the Governor of this intention. (This would remove any likelihood of a Court of Enquiry on the allegations which have been made about his conduct.)
