PERSONAL

CONFIDENTIAL

His Excellency the Governor,

Government House,

HONG KONG.

My dear oneings,

Mr. Justice Barker

120

00

I attach a copy of a letter of resignation

signed by Barker, J.A.

This he wrote after advice from me.

I had already shown the draft to Sir T.L.

Yang, who agreed to its terms.

I was not able to pass my draft to Barker, J.A. until 9th March, in the morning, as your letter, although dated 7th March, did not reach me until 8th March.

You will observe that Barker's letter differs from your own in only one respect, in that in the schedule to his letter, he is to be permitted leave in 1988, and a passage for himself and his wife in 1989. The effective date of his resignation is to be 1st January, 1989, or later if this is necessary for him to join the new pension scheme for the Judiciary.

Otherwise, the instructions given in your

letter have been followed.

Sir T.L. Yang supports the measures proposed, and will do his best to find non-judicial duties to occupy Barker, J.A. until later in the year. for the moment, left flexible.

This is,

Barker, J.A's resignation, in the terms offered, would offer a sensible compromise to a continuing difficulty.

I am most grateful to you and the Civil Service Branch for devising a humane formula, which has commended itself to the Judge and Sir T.L. Yang. I support it, also, and advise that you should accept it.

CONFIDENTIAL
