Mutual Judicial Assistance Agreement with
The People's Republic of China
Thank you for your letter of 25 July with its news of an encouraging response from Mme Zhang of the Chinese Ministry of Foreign Affairs. I will certainly begin preparing an exploratory memorandum on the subjects mentioned in my letter of 12 April to Claire Smith, namely:-
(a) service of judicial and extra-judicial documents
(b)
(c)
(a)
(e)
(£)
taking of evidence abroad
recognition and enforcement of judgments
recognition and enforcement of arbitral awards abolition of legalisation
exchange of legal information.
The timing of this places me in some difficulty, as I am shortly departing on leave and will be involved in negotiations for an EC/EFTA Judgments Convention shortly after my return on 5 September. I will then be away in Paris for a few days on an exchange between our administrative law judges and their counterparts in the Conseil d'Etat. I will try to produce some of the memorandum on my return in week 5-9 September and aim, if at all possible, to complete by 30 September. It will need circulation to interested Departments thereafter, so that I expect one could be ready about mid-October. I do not think I could manage this before then, and I hope this timetable is suitable. It would be agreeable to have more time, but I accept that we do not wish to appear uninterested towards the Chinese.
