MUTUAL JUDICIAL ASSISTANCE AGREEMENT WITH THE PRC

1.

I do not think that NTD can usefully add to what you have set out in the second paragraph of your circular minute of 18 March. We see no need for a bilateral agreement with the Chinese on civil matters, and agree with the Lord Chancellor's Department that this would be a second best to the Chinese acceding to the various multi- lateral Hague Conventions.

2. However we equally see no harm, providing that the LCD are able and prepared to do the necessary work, which now seems to be the case, and we would not wish to stand in the way of an agreement if it was thought that there was political benefit in negotiating one.
