Provisional Agreement between the High People's Court of the Guangdong Province and the Supreme Court of Hong Kong on the mutual assistance for the service of
documents in civil and economic proceedings
The High People's Court of the Guangdong Province and the Supreme Court
of Hong Kong have agreed in principle the following arrangements for the
mutual service of documents in civil and economic proceedings.

Both parties agree that each may entrust to the other party
the service of documents in respect of civil and economic
proceedings. Such documents include: copy of originating
process, copy of notice of appeal, writ of summons, judgment,
mediation award, ruling, letter of decision and notice.
When the entrusting party requests the entrusted party to
serve any of the above mentioned documents, it must produce,
its authorization bearing its official seal. The letter of
entrustment should be in the Chinese and English language. It
must also indicate the full name and address of the person to
be served.

The entrusted party must return to the
entrusting party proof
that the document has been served. If the iocument cannot be
served, the entrusted party must notify the entrusting party in
writing the reason for its failure in effecting service.
The entrusted party shall have no legal responsibility.
Forms of the above mentioned documents shall be exchanged by both parties.

The mutual service of the above mentioned documents shall be effected
through the Fish People's Court of the Guangdong Province and the
Supreme Court of Hong Kong.
