was explained by the Chinese side during

discussions that there were no prescribed forms for civil

rulings, but the general form, two examples of which have

been given, would be adapted to the circumstances of

individual cases.

The purpose of a civil ruling is very similar to

the giving of a summary decision in Hong Kong or the giving

of interlocutory orders during the course of the trial. Of

the examples given, the first one is of a summary order

dismissing proceedings when the Court forms the view that

there is no proper basis for the claim. The document is

considered unobjectionable as is the other example which

would be used for an interlocutory order for the

preservation of the subject matter of the litigation pending

the outcome of the proceedings.
