CRIMINAL JUSTICE BILL

-

EXTRADITION

1. I am sorry to have to revert to our correspondence about international conventions.

2. Nationality and Treaty Department here have pointed out that our amendments covering international conventions do not deal with the 1963 Tokyo Convention on Offences and certain other Acts Committed on Board Aircraft. The relevant provisions of United Kingdom law are in the Civil Aviation Act 1982. In particular, section 93 deals with extradition, and contains a deeming provision for the purposes of the application of the Extradition Act 1870.

3.

I think this means that we need an amendment to section 93 of the 1982 Act similar to the draft amendments to the other Acts which give effect to multilateral conventions. However, I would be grateful for your views.

4.

I apologise for not raising this point before now.
