1) ab
shall
determine whether the evidence would be sufficient
trant his
trial if the offence had taken place within the jurisdiction of
the court.
(4) For the purposes of the provisions of this Act specified
in subsection (2) above, in their application by virtue of an
Order in Council under the section as between the United Kingdom
and any other State any act or omission, wherever it takes place,
which constitutes-
(a) an offence mentioned in subsection (1) above; and
(b) an offence against the law of that State,
shall be deemed to be an offence committed within the territory
of that State.
(5) In this section "the Torture Convention" means the
United Nations Convention Against Torture and other Cruel,
Inhuman or Degrading Treatment or Punishment adopted by the
General Assembly of the United Nations on 10th December 1984.'
Application to Channel Islands, Isle of Man and colonies
Mr Secretary Hurd
To move the following clause-
'(1) Her Majesty may by Order in Council make provision for
extending sections [Torture] and Prosecutions for Torture]
above, with such modifications and exceptions as may be specified
in the Order, to any of the Channel Islands, the Isle of Man or
any colony.
(2) Sections 17 and 22 of the Extradition Act 1870 shall
extend to section ́Extradition under 2010 Beti above.
