1988年電影檢查條例草案

32. (1) 在不抵觸本條情況下,凡影片或物品在本條例生效之前,已 過渡性條文 根據經撤銷的規例第3或8條送或遞交,則緊接在本條例生效之前施行 的《1987年電影檢查規例》,須適用於該影片或物品——

(a) 適用情形,與該規例在緊接本條例生效之前適用於該影片或物品

的情形無異;及

(b) 一如本條例並未制定。

(2) 不論第(1)款有何規定,自本條例生效時起任何時間,該款所指 影片可根據第8(1)條送呈,而凡這類影片根據本條例送,則自送之日 起,本條例即適用於該影片,一如該影片並未根據經撤銷的規例第3條送 呈。

(3) 就本條而言,“經撤銷的規例”指

(b) 在本條例生效之前任何時間施行的《1987年電影檢查規例》

33. (1) 《公眾娛樂場所條例》修訂如下——

相應及其他修訂

(第172章)

(a) 廢除第5條;

(b) 在第7(1)條,删去(h)、(i)及(ia)段;

(c) 在第8(1)條,於“public entertainment"之後加入下文一

“, except a cinematograph display,”;及

(d) 在第9條,删去第(3)款。

(2) 《1987年電影檢查規例》現予撤銷。

(3) 《電視條例》第32條現予廢除。

(4)《1987年管制色情及不雅物品條例》修訂如下一

(a) 廢除第3條,以下文取代——

“Ordinance not to apply in case of certain films,

etc.

3. This Ordinance shall not apply in relation to any-

(a) film within the meaning of section 2(1) of the Film

Censorship Ordinance 1988-

(i) in respect of which there is in force a certificate of exemption issued under section 9, or a certificate of approval issued under section 13, of that Ordinance; or

(ii) which is approved for exhibition under

regulation 5 of the revoked regulations within the

meaning of section 32(3) of that Ordinance;
