BETTING DUTY (AMENDMENT) BILL 1987
(a) the money paid to the Club under section 4C(2) and (4) of the principal Ordinance on and after 1 July 1986 less any money paid by the Club under section 4C(2A) of the principal Ordinance on and after that date; and
(b) the amount of money that would have been paid to the Club under section 4C(2) of the principal Ordinance on and after 1 July 1986 had this Ordinance come into force on that date.
(2) If the amount determined under subsection (1)(a) exceeds the amount determined under subsection (1)(b), the Club shall pay the differ- ence to the Lotteries Fund.
(3) If the amount determined under subsection (1)(b) exceeds the amount determined under subsection (1)(a), the Chief Secretary shall authorize payment of the difference to the Club out of the Lotteries Fund.
Explanatory Memorandum
The main object of this Bill is to change the basis on which the Hong Kong Lotteries Board pays the Royal Hong Kong Jockey Club for facilities provided to the Lotteries Board for operation of the Mark Six Lottery. The present procedure requires the Chief Secretary to determine a percentage of lottery proceeds sufficient to cover the past year's actual costs. Clause 2(c) amends section 4C(2) to provide for a pre-determined 7.5 per cent.
2. Clause 2(a) and (d) also amends section 4C(1) and (3) to fix the prize share at 59 per cent and the Lotteries Fund share at 3.5 per cent respectively.
3. Each percentage may be amended by resolution of the Legislative Council under the amended section 4C(1A) (Clause 2(b)).

The effect of the transitional provision is that the commission paid
to the Club since 1 July 1986 will be 7.5 per cent (Clause 3).
5. There are no Public Service staffing or public expenditure implications.
