OCCUPATIONAL SAFETY AND HEALTH COUNCIL ORDINANCE 1988

This Ordinance establishes the Occupational Safety and Health Council for the purpose of fostering safer and healthier working conditions in Hong Kong.
2. The Council consists of a Chairman, a Vice-Chairman and 10 to 14 other members who are not public officers and who represent employers, employees, professional and academic interests. In addition, there are 5 other Council members who are public officers.
3. The resources of the Council mainly consist of all amounts of levy, contribution, surcharge and penalty received by it and all grants, loans, funds and donations. With the approval of the Financial Secretary, the Council may borrow money to meet its obligations.

The Ordinance provides for the imposition of a levy on employers taking out employees' compensation insurance policies and the levy is paid at the time of payment of the insurance premium. If an employer fails to pay the levy in time, the Council is empowered to impose a surcharge.
5.
The Ordinance gives an employer a right to object against any surcharge and the objection will be considered by the Council. A further right to appeal lies to the District Court.
6. Before the Deputy to the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
