This Ordinance amends the Public Health and Municipal Services Ordinance so as to clarify the procedure for obtaining a Prohibition Order in respect of premises used in contravention of licensing requirements or other statutory provisions. It also empowers a Magistrate's Court to make a Closure Order in respect of such premises where a Prohibition Order has not been complied with if the premises are used for a food business. If a Prohibition Order in respect of food premises is not complied with, an order authorizing the physical closure of such premises may be obtained after due notice has been given.
2. Various consequential and ancillary amendments are made by the Ordinance, including new forms for use by the Courts and provision to preserve the effect of existing Prohibition Orders.
3. Before the Deputy to the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
