By clause 5, the consultant dental surgeon in charge of the Dental Service of the Medical and Health Department is made the Registrar of Dentists in place of the Director.

6. Clause 7 sets out the consequential amendments to the Dentists (Registration and Disciplinary Procedure) Regulations. The powers and functions of the Director of Medical and Health Services under those regulations are transferred to the Chairman of the Council as the Director ceases to be the ex officio member and Chairman.

7. The Bill has no Public Service staffing or financial implications.

本條例草案的主要目的,在於授權香港牙醫管理委員會選舉該會主席 以代替現時由醫務衛生署署長出任該會當然會長暨主席的制度。本草案亦規定由牙 醫註冊主任取代醫務衛生署署長成為該會的當然委員。

草案第2(a)條在「主席」一詞的定義中,將在主席暫時缺席期間當選代主 席的委員會包括在內。

草案第3條取消醫務衛生署署長的當然委員資格,轉而規定牙醫註冊主 任為當然委員,並因而規定由港督取代醫務衛生署署長委任其他委員。本條文同時 授權港督委任一名非有關專業人士為委員,並就委員選舉主席與主席的任期、缺席 及辭職等事宜作出規定。草案第3條亦修訂原有條例第4(2)(b)條,為該條提及的職 位另訂新條文予以說明;新條文當較舊條文更為適當,並與草案第5條的條文相 符。

鑑於無需設立「會長」一職,草案第4及第6條取消「會長」的職銜,並 規定由主席或秘書履行該職的職責。

根據草案第5條規定,負責醫務衛生署牙科事務的牙醫顧問,現取代該 署署長出任牙醫註冊主任。

草案第7條列明牙醫(註冊及紀律處分程序)規例的相應修訂。由於醫務 衛生署署長不再是當然委員暨主席,原由該規例賦予的權力及職責,現轉授予牙醫 管理委員會主席。

7. 本草案對政府財政及人手需求都没有影響。
