This memorandum deals with an objection by a

Vietnamese boat person, Mr X, against the decision of

the Director of Immigration to refuse him refugee status under Section 53 of the Immigration Ordinance,

Cap. 115 (the Ordinance). Under the Ordinance, the

under Section 53 of the Ordinance, the refusal by the Director of Immigration to permit Mr X to remain in

Hong Kong as a refugee should be upheld.

Background

3.

On 13 September 1988, the Council advised and the Governor ordered that the appeals procedure as set out in Executive Council Memorandum XCC(88) 125

for screened out Vietnamese illegal immigrants be approved. This objection is dealt with in accordance with the approved procedure.
