Amendment of section 146.

SECURITIES (AMENDMENT)

(3A) In subsection (1) “function" includes a power and a duty."; and

(b) by deleting subsection (7) and substituting the following---

3.

“(7) Any person who contravenes subsection (1) or (3) shall be guilty of an offence and shall be liable-

(a) on conviction on indictment to a fine of $100,000

and to imprisonment for 2 years; or

(b) on summary conviction to a fine of $50,000 and to

imprisonment for 6 months.

(8) Any person who, without lawful authority or rea- sonable excuse, contravenes subsection (4) or (6) shall be guilty of an offence and shall be liable on conviction to a fine of $10,000 and to imprisonment for 6 months.".

Section 146(1)(a) of the principal Ordinance is amended by delet- ing "sections 19 and" and substituting the following—

1988.

"section".
