Annex A

An Agreement made the

11th

day of

Between the Government

August

1987

of Hong Kong (hereinafter called "the

H.K. Government") of the one part and Her Majesty's Secretary of

called "the Secretary of

(hereinafter

State for Transport

State") of the other part.

WHEREAS:

(i) The

Kowloon-Canton Railway Corporation is constructing

the North-west Railway (hereinafter called "the Railway")

in the New Territories, and the H.K. Government requires

that the Railway and each and every part thereof shall be

operated and maintained to a high standard of safety.

(ii)

Inspectorate

The Government of the United Kingdom have established in

the Secretary of State's Department а Railway

(hereinafter called "the Inspectorate")

whose purpose is to monitor and advise on safety

standards and requirements for the railways operating in

the United Kingdom.

(iii)

The Secretary of State has agreed that the Inspectorate

shall perform the duties more particularly set out in the

First Schedule hereto in respect of the Railway on behalf

of the H.K. Government upon payment of

of the fees and

monies more particularly set out in the Second Schedule

hereto.
