(Transfer of Hong Kong Undertaking) Bill 1988
The above named private Bill will shortly be delivered to you by Messrs. Linklaters and Paines, the solicitors for
he sponsors of the Bill.
The Bill is being treated as a reserved Bill under clause XXVI paragraph 4 of the Royal Instructions, as amending or altering the constitution, powers or privileges of a Banking Association. The Secretary of State's instructions are accordingly requested.
The purpose of the Bill is to transfer the Hong Kong undertaking of Rainier International Bank to the Daiwa Bank. It is based upon the Deutshe Bank (Merger) Bill, which was (after being amending in accordance with your advice) recently passed by the Legislative Council. However, the present Bill differs in some respects since it deals not with a merger but with a transfer of part of an undertaking. I will notify you of the views of the Commissioner Banking on the Bill and its preamble as soon as possible. Subject to his being satisfied that all is in order, may the Bill be proceeded with without further reference to the Secretary of State?
