Sir,
I move that the Public Finance (Amendment) Bill
1988 be read the second time.

The
Legislative Council will be dissolved on
25 August 1988. There is some doubt whether cer
certain
decisions made by the Finance Committee under the Public
Finance Ordinance, from the date of dissolution, will as a
matter of law continue to have effect. If they do not
continue to have legal effect, the normal conduct of the
Government's financial business would be disrupted. This
applies particularly to
to the delegation of power under
section 8(3) to the Financial Secretary to make changes to
the approved estimate of expenditure.

It is therefore proposed that the Public Finance
Ordinance should be amended to make it clear that decisions
of the Finance Committee
shall continue to have legal
effect after the dissolution of the Legislative Council.
