The censor, when making his decision under subsection (2), shall take into account the following
matters
(a)
(b)
the artistic, educational, literary cz scientific merit of the film and is importance for cultural or social reasons, having regard particularly to the preservation of freedom of express100;
the effect of the fila as a whole and its likely eifern on the persons likely to view
the film; and
(c)
in relation to the intended exhibition of the film, the circumstances of such exhib
ion.
and shall not reâuse to approve the film under subsection 2(b), or make a decision under subsection 2(e), or assign it a classification under section 12(1)(b) or (c) unless he is satisfied that the film -
(i)
unwarrantably portrays, depicts or treats cruelty, torture, violence, crime, horror, disability, sexuality or indecent or offensive language or behaviour; or
(ii) denigrates or insults any particular class of the public by reference to the colour, race, religious beliefs or ethnic or national origins or the sex of the members of that class; or
(iii)
will sericusly damage good relations with other territories.
