BASIC LAW

CONFIDENTIAL

Background

1.

Although we maintain the formal position that the drafting of the Basic Law is a matter for China, we have established direct channels which allow us to comment on and influence the draft as it

emerges.

The Chinese have said they welcome our views.

2.

Concern has recently been expressed that the provisions of the international human rights Covenants will cease to apply to Hong Kong in 1997. The present draft of the Basic Law and Chinese intentions as expressed to us put this worry beyond doubt.
