This Article on mutual legal assistance is in the general area that we are con- templating for a bilateral agreement with the United States. The only point that appears somewhat strange is the provision proposed in paragraph 4 (a) for transferring proceedings.
Incidentally, it is not clear what the relationship is between Article 5 and Article 6.1.
The provisions for adding to List A or List B are modelled on provisions in the Single Convention. However, I wonder if it is necessary to go through the Secretary-General and whether an appeal to ECOSOC is an efficient way of doing business. Those with experience of the Single Convention are better placed to judge.
I agree with Mr Nagler that we are likely to have problems over this. It would be as well to examine our experience of our arrangements with the United States.
