THE PRISONERS (RELEASE UNDER SUPERVISION)
ORDINANCE 1987

This Ordinance introduces two schemes designed to assist in the re-habilitation of offenders on their release from prison. For these purposes, the Ordinance establishes a Release under Supervision Board, to be presided over by a judge, which will consider the cases of individual prisoners.
Release under Supervision Scheme

2. This is a limited parole scheme. Under it, the Governor may on the recommendation of the Board order the release, subject to supervision, of a prisoner who has served at least half, or 20 months, (whichever is the greater) of a sentence of 3 years or more. Supervision orders will contain conditions relating to, for example the former prisoner's employment, residence, and obligations to report to a supervising officer. order will remain in force until the date on which the prisoner would have been released from his prison sentence if not granted remission.

Under this scheme a prisoner who has been sentenced to at least 2 years' imprisonment may, on the recommendation of the Board, be released to spend the last 6 months of his sentence in a hostel that is supervised by the Correctional Services Department, where he will be subject to conditions relating to inter alia the obtaining of employment. He may be permitted under the Ordinance to take leaves of absence for up to 5 days.
Revocation of Orders and Review of Decisions

Under both schemes the Governor has power to revoke orders after considering recommendations by the Board. There is also power for the Commissioner of Correctional Services to revoke an order where exceptional circumstances require that a former prisoner be immediately re-imprisoned.
