Hong Kong Forgery and Counterfeiting Provisions

The Attorney General of Hong Kong has determined that the territory's existing Forgery and Counterfeiting Laws need to be brought up to date and has suggested the English Forgery and Counterfeiting Act 1981 as a legislative model. I have been asked to assume responsibility for the preparation of drafting instructions and, as the proposal can be said to affect the local currency and also demands consideration of an U.K. treaty obligation, it is necessary that sanction of the Secretary of State for the proposed changes be sought in accordance with the provisions of Clause XXVI of the Royal Instructions to the Governor.

The existing laws, found at parts IX and XI of the Crimes Ordinance, Cap. 200, are cumbersome and outdated. In following the English model, Hong Kong will be implementing the recommendation of the Law Commission Report on Forgery and Counterfeit Currency Law Comm. No. 55/ published in England in 1973. It has been noted too that the Counterfeit Currency (Convention) Act 1935 applies to Hong Kong which purports to accomodate the Articles of the International Convention for the Suppression of Counterfeiting Currency (geneva, April, 1929).

I have caused all relevant government departments to be informed about the proposal and have had direct consultation with the Secretary for Monetary Affairs. He has seen the 1981 Act and approves of it as a model for the new legislation.
