A B 1. The Secretary of State will wish to see the attached personal

telegrams from the Governor of Hong Kong reporting a discussion

which he had with the Chief Justice recently about Mr Justice Barker

in the light of Lord Benson's letter about the Carrian trial.

2. It is perhaps regrettable, all things considered, that the Chief Justice did not accept Mr Justice Barker's resignation on one

of the two occasions when he tendered it. However, as the Governor

points out, there may be good compassionate grounds for delaying

further action in view of Mrs Barker's condition.

3. The Governor is well aware of the importance we attach to an

early resolution of the enquiries into the personal allegations

against Mr Justice Barker. But we must await the outcome of the

medical reports on his wife before matters can be taken any further.

4.

The Secretary of State sent an interim reply to Lord Benson on

21 December. There is no further action for the time being; but we

will be monitoring developments very carefully.
