central aspects of the ruling delivered by Mr Justice Barker in
bringing the Carrian trial to an end. Shortly afterwards the Chief
Justice suffered a mild stroke. We have however urged the Governor
to find a way to take forward quickly his enquiries into the
personal allegations against Mr Justice Barker, if necessary through the Acting Chief Justice. These will inevitably take some time if
they are to be conscientiously pursued.
5. Since Lord Benson has written again he should receive a further
interim reply. I suggest that this should enclose a copy of the
Court of Appeal judgement. I submit a draft. Mr Fifoot concurs
with all the above.
