As I expect you know we are required to localise those UK laws which apply to Hong Kong. Those which Civil Service Branch has to deal with are :-
Pensions (Colonial Service) Act 1887 Superannuation Act 1892 Superannuation Act 1965
Articles XIV XVI and XVIII of the Letters Patent.
As regards the Pensions and Superannuation Acts
I should be grateful if Mike Power could advise :-
(a) whether it is still necessary to apply
them to Hong Kong;
(b)
(c)
if so, whether they could be applied unilaterally by HMG without their being incorporated into Hong Kong Law; if they must be incorporated into Hong Kong Law which are the specific provisions in the Acts which need to be covered.
As regards the Letters Patent I should be grateful for confirmation that you see no objection to our incorporating these into appropriate laws and regulations while at the same time dropping reference to the Secretary of State. We would also propose to drop Section XVIII altogether.
