THE BUILDINGS ORDINANCE (APPLICATION TO THE NEW TERRITORIES) ORDINANCE 1987

This Ordinance repeals and replaces the
Buildings Ordinance (Application to the New Territories) Ordinance (Cap. 322) and regulations made thereunder.

The purposes of this Ordinance are
-
to apply the Buildings Ordinance to the New Territories subject to the exemptions which may be given under Part III of this Ordinance (section 3);
to empower the Director of Buildings and Lands
(i) to issue certificates of exemption for any building works in the New Territories (section 4);
(ii) to issue certificates of exemption for particular kinds of building works in the New Territories (section 5); and
(iii) where any such certificate of exemption is issued for building works, to issue a certificate of exemption in respect of related site formation works or drainage works (section 6).
3. The effect of any certificate of exemption issued under this Ordinance is to exempt buildings (subject to certain limitations as to size) built in accordance with the certificate from certain provisions of the Buildings Ordinance and regulations made thereunder (section 7).
